A Chinese pharmaceutical company, Huanjie, has been ordered to pay $1 billion to its American and Taiwanese customers.
The largest criminal case, against three Chinese companies, in the US District Court for the District of Massachusetts, has been handed down by a judge in Manhattan. The judge ordered Huanjie to pay $1.2 billion in damages to its American customers, and ordered it to pay $1.2 billion to the Taiwan firm. Huanjie will pay a total of $1.3 billion in damages to the two companies.
The judge in Manhattan, who was appointed by then-President George Bush, was in charge of the investigation, and ordered the two companies to pay more than $2 billion in punitive damages. The company did not immediately respond to a request for comment.
The US Justice Department's Office of Legal Investigation, which has a full report on the matter, has obtained more than 100 documents from China.
The latest in a string of civil and criminal cases has been against Huanjie for failing to pay punitive damages for its customers.
The cases stem from an alleged misapplication of a Chinese pharmaceutical company, which is involved in the purchase of Viagra, a treatment for erectile dysfunction.
The alleged mis-selling came after the company, based in Taiwan, had already entered into an agreement with Pfizer, which had been trying to secure the deal.
Pfizer had already entered into an agreement with Viagra manufacturer Bayer, which had also been trying to secure the deal.
It is unknown whether Pfizer actually had the drugs under consideration before Viagra was approved. It was, however, expected that the deal would be completed before Viagra could be approved.
A Chinese company was also involved in the purchase of Viagra, and the deal was reportedly finalized earlier this year.
In June, the US Justice Department's Office of Legal Investigation announced it would request all fouratteries and customs duties from China to promote the deal, and also from other countries to aid in the US government's efforts to secure the deal.
The announcement by the United States Justice Department was in response to a warning from China that the US would not pay any more than $100,000 to the two companies in damages.
In the latest case, Huanjie settled the case with a Chinese firm with $300,000 in damages, but only paid $4.5 million.
The new lawsuit involves two US companies, which were ordered to pay more than $2 billion in punitive damages to Taiwan.
On the heels of the deal, Huanjie said it would plead guilty to criminal charges and face a possible fine of $500,000.
Huanjie, based in New York, had been accused of several other charges in recent years, including theft and misbranding, among others.
The charges included four counts related to the purchase of Viagra, three counts of misbranding, and five counts of fraud.
The case is still before the US Food and Drug Administration and it is being prosecuted by a United States District Court in New York.
The US Food and Drug Administration, on behalf of the FDA, has warned that the three Chinese companies that Huanjie has sold to US customers, as well as other domestic and foreign companies, may be at risk of serious problems.
On Thursday, the US Justice Department said it was looking into the matter with the New York firm of Eli Lilly, saying that the companies had committed the acts they did in 2010 that led to the deaths of the two Chinese customers.
The latest case involves the Chinese pharmaceutical company, Cipla, which is involved in the purchase of Viagra, a treatment for erectile dysfunction.
The case was brought by Cipla, a British company that sold Viagra to the US government for $1.6 billion in 2010.
Cipla had already committed a criminal fine of $6 billion and was ordered to pay a combined total of $7.5 billion in damages to the three companies.
